Handelsbetingelser køber


1. Anvendelse og definitioner

Nærværende auktionsbetingelser (herefter benævnt ”Betingelserne”) finder anvendelse ved ethvert salg og ethvert køb via den online auktionsside www.kapow.eu, (herefter benævnt ”Auktionssiden”), og kan kun fraviges ved skriftlig accept fra Kapow Auktioner A/S, som ejer og driver www.kapow.eu.

Som Sælger er det dig, som sætter en vare til salg via Auktionssiden, og som Køber er det dig, som byder på/køber en Auktionsobjekt via Auktionssiden. Auktionsobjekt(et) er den maskine/vare, som via Auktionssiden udbydes til salg.

2. Registrering, sikkerhed og persondata

For at kunne handle via Auktionssiden skal du oprette en konto. Du skal være myndig, og når du opretter dig, bliver du bedt om at indtaste dit CVR nr./Vat no., virksomhedens navn, adresse, telefonnummer samt en e-mail adresse. Det er alene dit ansvar, at de af dig indtastede oplysninger er korrekte. Auktionssiden verificerer dine oplysninger før din konto aktiveres, ligesom du får tilsendt en e-mail, hvor du bliver bedt om at bekræfte din e-mail adresse. Hvis dine oplysninger ikke er korrekte, kan vi ikke oprette din konto.

Formålet med at enhver bruger skal oprettes er, at Kapow ønsker at give brugere størst mulig sikkerhed for betaling og afhentning af Auktionsobjektet. Derudover skal vi kunne kommunikere med vores brugere, hvis en handel kræver det.

Oprettelse er gratis, og du er ikke bundet af noget medlemskab. Når du er oprettet og registreret som bruger, kan du anvende auktionsmulighederne på Auktionssiden. Hvis du ikke længere ønsker at have en konto via Auktionssiden, kan du altid få den slettet, ligesom du til enhver tid kan rette henvendelse til Kapow Auktioner A/S med henblik på at få indsigt i, hvilke persondata vi har registreret på dig. Dog vil data, som er påkrævet for at overholde anden lovgivning ikke blive slettet. Ønsker du at få din konto slettet eller at få indsigt i hvilke persondata, vi har registreret, skal du rette henvendelse til support@kapow.eu. Som udgangspunkt bliver dine data alene slettet, hvis du ikke længere ønsker at have en konto på Auktionssiden. Da vi alene behandler ikke særligt personfølsomme data, er det ud fra en saglig vurdering ikke fundet nødvendigt, at slette dine data efter en nærmere afgrænset periode. Den dataansvarlige er den til enhver tid værende direktør i Kapow Auktioner A/S, og det er alene de medarbejdere, hvor der foreligger sagligt grundlag, som har adgang til dine data. Dine data videregives alene til vores danske samarbejdspartner Midt Factoring A/S, CVR Nr. 83712619 med hvem vi har indgået databehandleraftale. Midt Factoring A/S bistår med fakturering samt inddrivelse af auktionsbud. Derudover videregiver eller sælger vi ikke dine oplysninger til tredjemand.

3. Reklamationsret og ansvar

Under henvisning til købelovens § 48 kan du ikke påberåbe dig, at Auktionsobjektet lider af en mangel, medmindre sælger har handlet svigagtigt eller objektet ikke svarer til den betegnelse under hvilken den er solgt. Samtlige Auktionsobjekter sælges, som de er og forefindes, og som eventuelt beset af dig og uden ansvar for auktionssælger, leasingselskab, kurator, skifteretten eller Kapow Auktioner A/S.

Et eventuelt ansvar i tilfælde af svigagtig adfærd, eller hvis objektet ikke svarer til den betegnelse under hvilken den er solgt, kan alene rettes mod sælger, og er således Kapow Auktioner A/S uvedkommende.

4. Budgivning, betaling og misligholdelse

Ethvert afgivet auktionsbud er bindende, når auktionsbuddet er bekræftet og registreret på Auktionssiden. Når Køber afgiver sit bud, skal Køber desuden indtaste det maksimale beløb, som Køber  ønsker at byde på Auktionsobjektet. Dit bud vil automatisk blive hævet til det mindst tilladte beløb, når andre købere byder over dit gældende bud, indtil det tidspunkt, hvor dit maksimale beløb er nået. Er der flere Købere med samme sum i max bud ved auktionens afslutning, vil det først afgivne bud være gældende. Det er alene Auktionssiden, som kan se det af Køber indtastede maksimale beløb.

Samtlige auktioner har en reservationspris. Hvis højeste bud er det samme som, eller højere end reservationsprisen, sælges Auktionsobjektet. Er det afgivne bud lavere end reservationsprisen, har Sælger 24 timer til at meddele Auktionssiden om, hvorvidt Sælger vil acceptere det af Køber afgivne bud. Auktionssiden er forpligtet til indenfor 24 timer at give Køber besked om, hvorvidt Sælger har accepteret Købers bud.

Ved identiske bud vil det først afgivne bud være gældende. Bud afgivet mindre end 5 minutter før en auktion lukker bevirker, at auktionen automatisk forlænges med 5 minutter fra det tidspunkt, hvor det sidste bud er afgivet.

Betalingsfristen er 5 arbejdsdage. Senest 24 timer efter endt auktion modtager Køber faktura med angivelse af betalingsoplysninger. Når betaling er registreret hos Midt Factoring A/S fremsendes en udleveringsbekræftelse til Køber inklusiv relevante kontaktoplysninger til brug ved afhentning af Auktionsobjektet. Det nærmere tidspunkt for afhentning af Auktionsobjektet aftales direkte mellem Sælger og Køber, og er således Kapow Auktioner A/S uvedkommende.

Betaler Køber ikke rettidigt, eller reagerer Køber i øvrigt ikke på Kapow Auktioner A/S´ skriftlige henvendelse inden 24 timer efter udløb af frist for afhentning af Auktionsobjektet, betragtes forholdet som væsentlig misligholdelse, og auktionsaftale betragtes som ophævet.

Ved væsentlig misligholdelse er Kapow Auktioner A/S berettiget til at hæve auktionsaftalen over for den misligholdende Køber og tilbyde Auktionsobjektet til næsthøjeste bud eller til tredjemand.

Den misligholdende Køber er forpligtet til at godtgøre Kapow Auktioner A/S for differencen i både budsum og salær i forhold til den pris, varen opnår hos næsthøjeste bud eller tredjemand med et tillæg på 10%.

Hvis næsthøjeste bud eller tredjemand afviser at aftage Auktionsobjektet, og Auktionsobjektet på ny skal auktioneres, er den misligholdende Køber forpligtet til at dække alle rimelige omkostninger forbundet hermed.

Såfremt det måtte lykkes Kapow Auktioner A/S eller Sælger at afhænde den af den misligholdende Købers vundne Auktionsobjekt til tredjemand til en pris, der ligger over den misligholdendes Købers bud, er den misligholdende Køber ikke berettiget til at fradrage overskuddet i de ved salget forbundne omkostninger, ligesom den misligholdende Køber ikke kan gøre krav på overskuddet.

Kapow Auktioner A/S er berettiget til at ekskludere misligholdende Købere fra Auktionssiden. Samtlige data vil blive slettet, ligesom Kapow Auktioner A/S forbeholder sig retten til at nægte den ekskluderede Køber adgang til Auktionssiden fra den af dennes anvendte IP-adresse.

5. Finansiering og omkostninger

Alene Sælger er ansvarlig for, at Auktionsobjektet er fri og ubehæftet. Ethvert ansvar herfor er Kapow Auktioner A/S uvedkommende.

Såfremt Køber skal have sit køb finansieret, skal finansieringen være afklaret senest på det tidspunkt, hvor auktionen afsluttes.

Ved aftale med Køber om, at Køber indfrier eller overtager eventuelle hæftelser som led i købet, er Sælger forpligtet til at sikre, at Sælger kan frigøres for enhver forpligtelse overfor tredjemand samt, at tredjemands rettigheder i forhold til Auktionsobjektet ophører senest på tidspunktet for auktionsaftalens indgåelse.

Auktionsgebyr udgør 5 %, dog maks. 5.000 kr af det samlede auktionsbud, samt faktueringsgebyr udgør 250 kr.  og betales af Køber. Omkostningerne er indeholdt i den endelige Auktionspris. 

6. Moms

Alle budpriser samt håndteringsomkostninger og faktureringsgebyr er angivet eksklusiv moms. Der tillægges moms på Auktionsobjektet samt moms på auktionsgebyr, medmindre Auktionsobjektet måtte være fritaget for moms.

For Købere bosiddende i EU pålægges Auktionsobjektet og salæret dansk moms. Alle fakturaer vil således være momsbelagt, medmindre Køber fremsender behørig dokumentation for, at varen udføres af Danmark, hvorved Kapow Auktioner A/S vil refundere momsbeløbet og udstede kreditnota og ny faktura uden moms.

Som dokumentation skal Kapow Auktioner A/S modtage fragtbrev, faktura fra et fragtfirma, eller anden behørig dokumentation på, at varen udføres af Danmark. Såfremt denne dokumentation ikke modtages, eller i tilfælde af at Køber selv afhenter Auktionsobjektet, påhviler det Køber af søge den danske moms refunderet hos de danske skattemyndigheder.

Købere bosiddende udenfor EU kan fritages for dansk moms, når det kan dokumenteres, at Auktionsobjektet er transporteret ud af EU. Køber kan undlade at gøre brug af muligheden for momsfritagelse og i stedet vælge at betale dansk moms. Det er Købers pligt at sikre sig, at momsnummeret er gyldigt inden budgivning. Kapow Auktioner A/S kontrollerer om momsnummeret er gyldigt på denne hjemmeside: http://ec.europa.eu/taxation_customs/vies/?locale=da.

Såfremt momsnummeret ikke er gyldigt, vil Auktionsobjektet blive pålagt dansk moms.

7. Tyveri eller sabotage

Hvis Kapow A/S konstaterer tyveri eller forsøg på tyveri, sabotage eller forsøg på sabotage, medfører det politianmeldelse og udelukkelse fra at kunne byde på Kapow Auktioner A/S fremover.

8. Risikoens overgang

Køber bærer risikoen for Auktionsobjektet fra det tidspunkt, hvor auktionen lukkes. Såfremt Auktionsobjektet skal afmonteres, nedtages eller sikres, sker dette for Købers egen risiko og regning.

Alt læsning foregår på Købers eget ansvar. Kapow Auktioner A/S er ikke ansvarlig for skader på købte varer eller andre ting. Vi hjælper gerne, men kun på købers ansvar.

9. Ændringer i betingelser og kataloget samt forbehold for fejl

Kapow Auktioner A/S forbeholder sig ret til ændringer i kataloget, herunder at lade varer udgå af auktioner. Kapow Auktioner A/S tager forbehold for stavefejl, skrivefejl, billedfejl, forkerte angivelser af antal, mål, vægt, kapacitet og momsstatus.

Kapow Auktioner A/S er ikke ansvarlig for eventuelle systemfejl eller andre tekniske forhold, som måtte påvirke auktionssystemet og budgivningen.

Opstår der tekniske problemer ved afslutning af en auktion, er Kapow Auktioner A/S berettiget til at genstarte hele auktionen, og lade den afslutte på et senere tidspunkt, typisk samme tid efterfølgende dag, eller når tekniske problemer er løst. Alle aktive bydere vil få besked på mail hurtigst muligt.

11. Lovvalg og værneting

HOW LONG DO WE KEEP YOUR INFORMATION? 

In Short: We keep your information for as long as necessary to fulfil the purposes outlined in this privacy policy unless otherwise required by law.
